SHIPPING & SALES CONDITIONS
By registering, bidding for and purchasing wine from BRENTWOOD WINE COMPANY, the purchaser hereby agrees to the following:
1.) The purchaser states that he/she is at least 21 years of age. If requested, the purchaser will make a copy of his/her legal I.D. available to Brentwood Wine Company and/or provide it to the designated carrier.
2.) By bidding on wine at auction, the purchaser is entering into an agreement to purchase wine if the purchaser's bid proves to be a winning bid at the completion of the auction. Upon completion of the auction, if a purchaser's bid is deemed by Brentwood Wine Company to be a winning bid, the credit card submitted during registration will be debited for the amount of the bid plus buyer's premium and shipping charges. For a purchase of products in "Fixed Price Wine", completion of the "check out" page or submission of an order by E-Mail, fax or voice will constitute sale of product and result in debit of the credit card. If a charge is not honored, or is later revoked for any reason other than error by Brentwood Wine Company, the purchaser will become liable for all collection fees to gain payment, plus accrued interest and administration fees. In such a case, Brentwood Wine Company, may, at its sole discretion choose to sell the wine to another customer. In this case, the original high bidder will be liable for the difference between his/her bid and the amount realized, as well as interest and administration fees.
3.) Title to, and ownership of, all wine passes from Brentwood Wine Company to the purchaser in the State of Oregon and the purchaser takes all responsibility for the shipping
from Oregon to his/her home state. By arranging for transportation of the wine, Brentwood Wine Company is providing a service to, and acting on behalf of the purchaser. By utilizing this service from Brentwood Wine Company, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered. Also, we cannot ship to New Hampshire, Massachusetts
and Texas.
4.) The purchaser acknowledges that he/she understands that wine is a perishable item and acknowledges that he/she will make every attempt to take personal delivery immediately upon arrival by carrier and will thereafter properly store the wine. The purchaser will hold Brentwood Wine Company and the utilized carrier harmless for any damage, other than breakage or loss, incurred by the wine if delivery is not taken on the first attempt from the carrier or if the damage is not reported on the day of delivery to both the carrier and Brentwood Wine Company.
5.) All wine offered in the Wine Shop is subject to limited availability and sale is based on inventory on hand. We reserve the right to substitute vintages for such sales unless notified otherwise in the 'Shipping Instructions' of the order form.
6.) Brentwood Wine Company reserves the right to refuse sales to anyone without specified reason and may likewise change quantities sold, withdraw an item from sale or complete an auction at a different date then specified.
7.) Brentwood Wine Company is not responsible for typographic errors or errors in software execution, errors in transcription or editing, computer system operation or Internet communication.
8.) All information provided by Brentwood Wine Company is meant solely for entertainment and recreational purposes and should not be treated as investment advice.

SHIPPING & HANDLING CHARGES
Shipping Charges
We ship auction wine in a way that maintains the quality at the lowest reasonable shipping cost to you. We do not make a profit on shipping, only charging you about what the carrier charges us. The methods we use vary by location and time of year. We can follow specific shipping instructions outside of these normal methods, if you prefer.
However, if you decide to ship your wine under your
selected ship method you take full responsibility for
any and all damages done
to wine because of temperatures. Contact shipping@brentwoodwine.com if you have any special shipping needs. Please note that USPS will not ship wine.
And if it absolutely has to go out tomorrow, we now offer rush shipment, guaranteeing shipment the business day following your order or a refund and explanation. You only need to select one unit of rush shipment for your entire order!
Handling Charges
There is no handling fee charged for auction winnings.
Handling charges are included in shipping for bulky and fragile items in the Wine Shop to cover the costs of packing material and some of the packing labor. We do not make money on handling fees
in fact, we don't even cover our costs for this!
Riedel Crystal
A handling charge of $5 is added to each complete Riedel "packing unit" - generally 1 decanter, 2 "Grand Cru" glasses or 4-6 other glasses - to cover the cost of shipping and packing materials. This is prorated for partial packing units. Please allow 90 days for special order items.
Wooden Wine boxes
Handling for each wooden box is $12.00. We only ship these if available and requested. Except in very rare cases, all bottles are removed from wooden boxes and shipped separately for safety.
Other items
There is no handling charge for small, non-fragile items such as corkscrews or books. A handling charge of $5 is added to other fragile and/or bulky items, including decanters and large items to cover the cost of shipping and packing materials.
A handling charge of $2 is added to any order of Private Preserve that is not shipped together with wine.
In the spirit of recycling, to reduce waste and keep our rates low, we may utilize used shipping material, which has been inspected and determined to be in excellent condition, unless you request otherwise.

INSURANCE
All shipments are insured for their replacement value and we will handle any claim paper work. Where a replacement is available, we will ship it to you. Where such replacement is not possible, such as for rare wine, we may refund all costs of purchase instead.
Please note that shipping insurance does not cover damage due to heat or freezing. We endeavor to ship in such a way as to avoid such damage, but in questionable circumstances will attempt to contact you about alternatives. Please notify us immediately is you believe such damage has occurred.

GIFT WRAPPING
We can now gift wrap most items (other than wine, wineracks, and storage cabinets of course!). We use a nice gold foil wrap appropriate for any occasion. Select the number of items you want gift wrapped. If this not the same as the number of items you have ordered, please explain the specifics in special shipping instructions at check out.
Gift cards are always free. Just add your message in Special Shipping instructions at check out.

RETURN POLICY
Brentwood Wine Company will accept for return wine and wine accessories (except racks and storage cabinets - see below) that are defective or in error, and provide a replacement, or at our option, a full credit if we are notified within 7 days of receipt. Where an item is broken in transit, we will provide a replacement, or at our option, a complete credit. Please save all broken items until notifying Brentwood Wine of breakage. Brentwood Wine will cover all reasonable shipping costs in these cases.
Brentwood Wine Company will provide a credit in the amount of the item cost, not including shipping, handling or return costs, for other wine accessories returned to us in resalable condition, if notified within 5 days of receipt and followed up within 15 days of purchase with return of the item(s). This credit is good for any item we sell, as long as other conditions of sale are met. Request for cash credit in such a case may incur a service charge, if approved.
Authorization for return must be requested within 5 business days of the receipt of an item. Contact us at info@brentwoodwine.com or (503) 638-9463 to receive authorization to return an item, before sending it. Return shipments should be made to:

Due to the perishable nature of wine that we sell and applicable laws, wine which has been properly identified can only be returned for a credit with previous authorization. Please direct related inquiries to info@brentwoodwine.com or (503) 638-9463.
Brentwood Wine Company is acting as an agent for the sales of wine racks and storage cabinets. These items cannot be returned to Brentwood Wine. Purchasers of these items should work directly with the manufacturer in the case of a defective item. Brentwood Wine Company will endeavor to assist in such a case to assure full customer satisfaction but cannot provide credits, refunds or replacements for these items without the approval of the manufacturer.
